This Privacy Policy explains how we, Shreyash Shastri, an individual based in India (“we,” “us,” or “our”), collect, use, disclose, and safeguard your information when you use Smars AI (“Smars”) and related services (collectively, the “Services”).

By accessing or using the Services, you agree to the collection and use of information in accordance with this Privacy Policy. If you do not agree, please do not use the Services.

Definitions

Personal Data / Personal Information: Any data about an individual who is identifiable by or in relation to such data, as defined under applicable data protection laws, including the Digital Personal Data Protection Act, 2023 (India).

Input: Content you submit to Smars, including prompts, questions, text, files, or images.

Output: Content generated by Smars in response to your Input.

Conversations: The combination of Inputs and Outputs.

Training Data: Data used to improve and develop Smars, excluding personal data where feasible.

1. Information Collected

We collect various types of information from and about users of our Services, including:

1.1 Information You Provide

  • Account Information: When you create an account, we collect your email address, and other contact information.
  • Payment Information: Billing details required to process payments. Payment information is handled securely by third-party payment processors; we do not store full card details.
  • User Content: We collect the Inputs you provide to Smars, including prompts, questions, instructions, and any files or data you upload.
  • Communications: Information you provide when contacting us (e.g., email content).

1.2 Information Collected Automatically

  • Usage Information: We collect information about your interactions with Smars, including the features you use, the time, and duration of your activities.
  • Log Information: Our servers automatically record information created by your use of the Services, including your IP address, browser type, operating system, referring/exit pages, clickstream data, landing page, and date/time stamps.
  • Cookies and Similar Technologies: We use cookies and similar tracking technologies to track activity on our Services and hold certain information. These technologies help us understand how you use the Services, personalize your experience, and improve the performance of our Services.

2. Purpose of Data Processing

We process personal data only for lawful and specific purposes, including to:

  • Provide, operate, maintain and improve the Services
  • Develop new products, services, features, and functionality

3. AI Training and Improvement

3.1 Explicit Consent for AI Training

We do not use your personal data for AI training or model improvement without your explicit consent.

  • AI training is opt-in only
  • Consent is requested clearly within the product interface
  • By default, personal data is NOT used for AI training.
  • You may withdraw consent at any time

3.2 What May Be Used (With Consent)

If you provide consent, we may use:

  • Inputs and Outputs
  • Conversations

Only after applying reasonable measures to remove or anonymize personal identifiers where feasible.

3.3 What Happens If You Do Not Consent

  • Your data will not be used for AI training
  • You can still use the core Services without restriction

3.4 Withdrawal of Consent

You may withdraw consent at any time by:

  • Disabling AI training in the Settings section of the app, or
  • Contacting us using the details provided in the Contact Information section.

Upon withdrawal of consent, we will stop using your future Inputs, Outputs, and Conversations for AI training and model improvement until you choose to re-enable AI training in the app settings.

Data that was processed before withdrawal and has been anonymized and aggregated may continue to be used where legally permitted.

4. Information Sharing

We do not sell your personal data.

4.1 Service Providers

We may share your information with third-party vendors, service providers, contractors, or agents who perform services for us or on our behalf, such as:

  • Cloud infrastructure and database providers
  • Payment processors
  • Customer support services
  • Analytics services
  • Security services

These providers are contractually obligated to protect your data.

4.2 Legal Reasons

We may disclose information if required to:

  • Comply with a legal obligation or process, such as a court order or subpoena
  • Protect and defend our rights or property

4.3 Business Transfers

Our Services are not directed to children under the age of 18, and we do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will promptly delete such information.
