Terms of Use

These Terms and Conditions (“Terms”) govern your access to and use of Smars AI (“Smars”) and related services (collectively, the “Services”), operated by Shreyash Shastri, an individual based in India (“we,” “us,” or “our”).

By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not access or use the Services.

1. Eligibility and Account Registration

1.1 Age Requirement. You must be at least 18 years old to use the Services. By using Smars, you represent and warrant that you meet this requirement.

1.2 Account Registration. To access certain features, you must create an account. You agree to:

  • Provide accurate and complete information
  • Maintain the security of your login credentials
  • Be responsible for all activity under your account

You may not share your account credentials or allow others to access your account.

2. Acceptance and Compliance

By using the Services, you agree to:

  • These Terms
  • Our Privacy Policy
  • All applicable laws and regulations

If you are using the Services on behalf of another person or entity, you confirm that you have authority to bind them to these Terms.

3. Use of the Services

3.1 Permitted Use: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for lawful purposes.

3.2 Prohibited Uses: You agree not to use the Services for any purpose that is illegal, harmful, or otherwise objectionable. This includes, but is not limited to:

  • Violating any applicable laws or regulations.
  • Infringing on the intellectual property rights of others or myself.
  • Generating content that is hateful, harassing, abusive, or promotes discrimination.
  • Attempting to reverse engineer, decompile, or discover the underlying source code or algorithms of the Services.
  • Using automated systems (bots, scrapers) to access the Services in a way that sends more requests than a human can reasonably produce in the same period.
  • Interfering with or disrupting the integrity or performance of the Services.
  • Using the output to develop models that compete with Smars.
  • Representing output from the Services as human-generated when it is not.
  • Using the Services for any high-risk activities where failure could lead to death, personal injury, or severe environmental damage without appropriate safeguards and human oversight.

3.3 Service Availability and Changes: We may modify, suspend, or discontinue all or part of the Services at any time, with or without notice. We do not guarantee that any feature or functionality will remain available. We are not liable for any modification, suspension, or discontinuation of the Services.

4. AI Content, Input, and Output

4.1 Your Input: You are responsible for all content you submit (“Input”). You represent that you have the necessary rights to provide such Input and that it does not violate these Terms or applicable laws.

4.2 AI Output: The Services generate responses (“Output”) based on your Input. Output is generated probabilistically and may be inaccurate, incomplete, or inappropriate.

4.3 No Professional Advice: Output is provided for informational purposes only and does not constitute legal, medical, financial, or other professional advice. You must independently verify Output before relying on it. You acknowledge that you are solely responsible for how you interpret, use, and apply Output, including any decisions or actions taken based on it.

4.4 Ownership: As between you and us:

  • You retain ownership of your Input
  • Subject to compliance with these Terms, you may use Output generated for you
  • We retain all rights to the Services, models, software, and underlying technology

4.5 Similarity of Output: Due to the nature of AI systems, Output may not be unique, and similar responses may be generated for other users.

5. Data Use and AI Training

Use of data for AI training and improvement is governed by our Privacy Policy, including your ability to enable or disable AI training through app settings.

6. Third-Party Services

The Services may integrate third-party services or display third-party content. We are not responsible for third-party services, which are governed by their own terms.

7. Feedback

If you provide feedback, suggestions, or ideas, you grant us the right to use them without restriction or compensation.

8. Intellectual Property

All rights, title, and interest in the Services, including software, models, algorithms, and design, are owned exclusively by Shreyash Shastri. These Terms do not grant you any ownership rights.

9. Suspension and Termination

We may suspend or terminate your access at any time, with or without notice, if:

  • You violate these Terms
  • Your use poses legal, security, or operational risk
  • Required by law

You may stop using the Services at any time.

10. Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

WE DO NOT GUARANTEE THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, OR THAT ANY ERRORS WILL BE CORRECTED.

11. Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for indirect, incidental, consequential, or punitive damages, including loss of data, profits, or goodwill.

Our aggregate liability for all claims arising out of or relating to the Services shall not exceed the greater of:

  • INR ₹1,000, or
  • The amount you paid us in the six months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Shreyash Shastri from any claims, damages, losses, or expenses arising from your use of the Services or violation of these Terms.

13. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Courts located in Bengaluru, Karnataka, India, shall have exclusive jurisdiction.

14. Changes to These Terms

We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the revised Terms.

15. Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign or transfer these Terms in connection with a merger, acquisition, reorganization, or sale of assets.
